DIAZ-BALART REQUESTS ARREST AND TRIAL OF CASTRO IN GERMANY

Washington, DC - Congressman Lincoln Diaz-Balart (R-FL) has formally asked the government of the Federal Republic of Germany to arrest, prosecute and try Cuban dictator Fidel Castro for crimes against humanity if, as has
been reported in the press, he travels to Germany later this month.

Citing the specific articles of the International Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, Diaz-Balart asked the German Justice Minister to arrange for Castro's arrest and trial for crimes against humanity if he visits Germany.  

"Castro must be arrested and tried for the crimes against humanity that he began committing in January, 1959, and has continued to commit to this day.  Sooner or later he will be charged, for jurisdiction is universal for crimes against humanity.  It would constitute a great and historic honor for Germany if it is the first country to charge Castro for crimes against humanity under the Convention Against Torture.  Every country that is a signatory to the Convention Against Torture where Castro seeks to visit, is obligated to indict the Cuban dictator for crimes against humanity ," said Diaz-Balart.

"It has been reported in the press that Fidel Castro, the Communist dictator of Cuba, may visit the Federal Republic of Germany later this month.

Pursuant to the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which the Federal Republic of Germany ratified on September 30, 1990, I hereby request that you take all necessary steps to arrest, prosecute and try Fidel Castro for crimes against humanity if he enters Germany.

Articles I, IV, V, VI, VII and VIII of the Convention Against Torture provide that torture offenses shall be prosecuted by each State Party to the Convention.  Based on the doctrine of universal jurisdiction, each State Party is required by the treaty to establish its jurisdiction over torture offenses when the alleged offender is present in any territory under its jurisdiction, or to extradite said criminals.

Fidel Castro has committed thousands of documented crimes of torture in Cuba.  Specifically, the named dictator has perpetrated a systematic campaign of repression and terror, including murder and torture against opponents of his regime, since he seized control of Cuba in January of 1959.

On July 13, 1994, the named dictator ordered the murder by forced drowning of over 40 refugees who were seeking to flee Communist Cuba, including more than 20 children.  On February 24, 1996, the named dictator acted as the principal in the premeditated murder of three U.S. citizens and one U.S. resident in the shoot-down of their unarmed civilian aircraft over international waters.  Thereafter, Fidel Castro assumed personal responsibility for the murders of the shoot-down victims: Armando Alejandre, Carlos Costa, Mario de la Pena, and Pablo Morales. To uphold the force of the Convention Against Torture, Fidel Castro must be charged for his crimes against humanity.  Accordingly, I am hereby requesting that the Federal Republic of Germany take all necessary steps to arrest, prosecute, and try Fidel Castro should he set foot on German soil."

DIAZ-BALART PIDE ARRESTO Y JUICIO DE CASTRO EN ALEMANIA

Washington, DC - El Congresista Lincoln Díaz-Balart (R-FL) ha pedido formalmente al gobierno de la Republica Federal de Alemania que detenga, encause y juzgue al tirano cubano Fidel Castro por crímenes contra la humanidad si, como ha sido informado por la prensa, él viaja a Alemania más tarde este mes.

Citando los artículos específicos de la Convención Internacional Contra la Tortura y Otros Tratos o Castigos  Crueles, Inhumanos o Degradantes, Díaz-Balart pidió a la Ministro de Justicia alemana que detenga y juzgue a Castro por crímenes contra la humanidad si Castro visita Alemania.

"Castro debe ser arrestado y juzgado por los crímenes contra la humanidad que ha cometido desde enero de 1959, y que ha continuado cometiendo hasta el día de hoy. Tarde o temprano él será encausado, ya que la jurisdicción es universal para los crímenes contra la humanidad. Constituiría un gran e histórico honor para Alemania si es el primer país en encausar a Castro por crímenes contra la humanidad bajo la Convención Contra la Tortura. Todo país que es firmante de la Convención contra la Tortura esta obligado a encausar al dictador cubano  por crímenes contra la humanidad, si Castro pretende visitar a cualquiera de esos países, " dijo Díaz-Balart.

"Ha sido reportado en la prensa que Fidel Castro, el dictador comunista de Cuba, podría visitar la Republica Federal de Alemania a finales de este mes.

De acuerdo con la Convención Contra la Tortura y Otros Tratos o Castigos Crueles, Inhumanos o Degradantes, que fue ratificada por la Republica Federal de Alemania el 30 de septiembre de 1990, le pido  que tome todos los pasos necesarios para detener, encausar y juzgar a Fidel Castro por crímenes contra la humanidad si él llega a Alemania.

Los artículos I, IV, V, VI, VII y VIII de la Convención Contra la Tortura establecen que los actos de tortura deben ser encausados por cada estado signatario de la Convención. Basándose en la doctrina de jurisdicción universal que establece la Convención, cada Estado signatario tiene la obligación de establecer su jurisdicción sobre los crímenes de tortura cuando la persona que comete dichos crímenes esta en cualquier territorio bajo su jurisdicción, o extraditar a dichos criminales.

Fidel Castro ha cometido miles de crímenes documentados de tortura en Cuba. Específicamente, el dictador ha perpetrado una campana sistemática de represión y terror, incluyendo asesinatos y torturas, contra los que se han opuesto a su régimen desde que tomo el poder en Cuba en enero de 1959.

El 13 de julio de 1994, el dictador ordenó el asesinato ahogando por la fuerza a más de 40 refugiados que buscaban escapar de Cuba comunista, incluyendo a más de 20 niños. El 24 de febrero de 1996, el dictador fue el autor intelectual del asesinato premeditado de 3 ciudadanos norteamericanos y un residente norteamericano en el derrumbamiento de sus avionetas desarmadas sobre aguas internacionales.  Poco después, Fidel Castro asumió la responsabilidad personal por los asesinatos de las victimas del 24 de febrero de 1996: Armando Alejandre, Carlos Costa, Mario de la Pena, y Pablo Morales (en una entrevista con la revista Time con Reginald K. Brack, Jr., Joelle Attinger, y Cathy Booth, publicada el 11 de marzo de 1996).

Para hacer cumplir la Convención Contra la Tortura, Fidel Castro tiene que ser encausado por sus crímenes contra la humanidad.  Por lo tanto, yo le pido que la Republica Federal de Alemania tome todos los pasos necesarios para detener, encausar y juzgar a Fidel Castro si él pisa suelo alemán."
